12/2/03: The Appellate Division (the first level of appeals in New York) agreed on December 2, 2003 to review Judge Lawliss's refusal to grant David Wong a new trial. A new trial would give David the chance to present newly discovered evidence to a jury and finally prove his innocence and victimization by the criminal justice system. A full report is now available, including copies of key legal filings.

The prison authorities put David in isolation, preventing him from hearing of Judge Lawliss's decision for three days.
11/1/03: Details are now emerging that on the same day that Judge Lawliss issued his decision to deny David's request for a new trial, prison guards were putting David in lockdown, which left him out of contact with the outside world. As a result, David did not find out about the ruling until three days later. The prison authorities justified putting him in lockdown by claiming that he was "in possession of unauthorized organization material." It is suspicious, however, that the supposedly unauthorized material was hidden in one of five letters that a guard handed David just hours before they searched his cell. Email us for more details.
