In [August] 2002, David's lawyers filed a motion before Judge Lawliss in New York Supreme Court (in New York, that is the trial court) requesting a new trial for David Wong. Some of the main reasons why David deserves a new trial is that (1) newly discovered evidence shows that one of the prosecution's two witnesses testified falsely -- he said he saw David commit the murder when he actually did not see what happened and (2) newly discovered evidence identifies the real killer, who told others that he did it. NEWS: Judge Lawliss orders an evidentiary hearing!
February 2003: UPDATE -- Judge Lawliss ordered an evidentiary hearing so that he could see the newly discovered evidence before ruling on whether or not to give David a new trial! The judge's order did not set the date when the evidentiary hearing will take place. It will be held in the judge's courtroom, which is in upstate New York.
UPDATE: The judge has set April 10-11 for the hearing. We informed the judge that more days might be needed. The judge will consider our request for more days only after he holds the April 10-11 hearing. Click here for the images of Judge Lawliss's actual order.
